February Edition 2021
The biggest challenge is managing my time -- balancing the day-to-day work with my legal team and handling one-off big projects, such as our protecting our IP portfolio, acquisitions and various litigation. The challenge is also part of the thrill. What types of work do you outsource? What do you look for and value mostly from outside legal counsel? Rachel: Early on in my career I met with a general counsel who told me he viewed his position somewhat akin to that of a family doctor. He explained that he tried to address all matters he could in-house and used outside counsel as “specialists.” I have embraced that philosophy. We use outside counsel in geographies in which we open new business and lack specific know-how needed for employment or establishment of new entities. We use outside counsel to manage litigation and of course, for patent prosecution and litigation. We use outside counsel where language is a barrier or when we acquire a company in a new geography and need familiarity with local laws. Given that we have a team of 10 lawyers in-house, I try to keep as much of the commercial and day-to-day work in house. Even in our M&As, we do a lot of the heavy lifting on our own since the knowledge gained remains in- house and is valuable as we integrate and manage the acquired companies. How do you see this sector developing? Rachel: For us, our products offer innovative and sophisticated technology that has proved attractive to clean energy worldwide. Wherever a government incentivizes its consumers to purchase renewable energy products, we thrive. Thankfully, for both our company and sustainable living worldwide, this trend continues. Whichkey renewableenergyor solar networkingeventsor conferences do you attend or are you aware of? Rachel: As a company, we are present at all of the big renewable energy shows: Intersolar, Solar Power International (SPI) and other local events globally. These were all cancelled or delayed this year (or held virtually) due to COVID. I keep up with renewable energy news through various bulletins and local law firm updates as well as the ACC website and the ACC Energy Committee. When you are not involved inmajor transactions, what do you do for fun? Rachel: Major transactions are fun! Alongside work, I have a vegetable garden that I tend to every Saturday morning with two friends and I take daily walks with my husband, dog and family. 36
